VOLUNTEER RELEASE AND WAIVER OF LIABILITY
In consideration for the willingness of Foundation for Hospital Art, Inc. (“FHA”) to accept the individual signing below (“Volunteer”) as a volunteer, and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged, Volunteer does freely, voluntarily and without duress execute the following Release for and on behalf of him or herself and his or her heirs, successors, beneficiaries and assigns:
- Waiver and Release. Volunteer releases, forever discharges, indemnifies, and holds harmless FHA and its directors, officers, employees, volunteers, agents, successors and assigns (collectively the “Released Parties”) from any and all liability, claims, demands and causes of action of whatever kind or nature, either in law or in equity, arising out of or relating to Volunteer’s activities at FHA (“Activities”), including but not limited to any claim for any bodily injury, personal injury, illness, death or property damage that may arise out of, occur during or result from the Activities, regardless of whether caused in whole or in part by an act or omission of a Released Party. Volunteer also understands that, except as otherwise agreed to by a Released Party in writing, the Released Parties do not provide any financial assistance of any kind, including but not limited to medical, health or disability insurance coverage for any volunteer.
- Copyright and Intellectual Property. Volunteer acknowledges that any painting or artwork (the “Work”) created during the course of volunteering with FHA is done on behalf of and for the benefit of FHA. FHA owns all rights, titles, and interests of every kind and nature whatsoever in the Work, including all copyrights, and Volunteer hereby assigns to FHA exclusively all rights, titles, and interests of every kind and nature whatsoever in and to the Work, including all copyrights and other intellectual property rights, that it may have in the Work. Volunteer appoints FHA as Volunteer’s agent and attorney-in-fact, with full power of substitution, to execute and deliver such assignments, documents, and instruments as Volunteer may fail or refuse to execute and deliver, this power and agency being coupled with an interest and being irrevocable.
